Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and SynapSys Software ("we", "us") governing your use of the GeoChopper game, this website, and related services (together, the "Service"). This agreement also serves as the End User License Agreement (EULA) for the GeoChopper app. Please read it carefully. By downloading, installing or using GeoChopper, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance and eligibility

By using the Service you confirm that you are able to form a binding contract with us, or that you have the consent of a parent or legal guardian who agrees to these Terms on your behalf. If you are using GeoChopper on behalf of a minor, you are responsible for their use of the Service and for their compliance with these Terms.

2. License to use GeoChopper

Subject to your compliance with these Terms, SynapSys Software grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use one copy of the GeoChopper app on a device that you own or control, solely for your personal, non-commercial entertainment and educational use.

You agree that you will not, and will not allow anyone else to:

• copy, modify, translate or create derivative works of the Service, except as permitted by law;
• reverse engineer, decompile or disassemble the app, or attempt to extract its source code, except to the extent this restriction is prohibited by applicable law;
• rent, lease, lend, sell, redistribute, sublicense or commercially exploit the Service;
• remove, obscure or alter any copyright, trademark or other proprietary notices;
• use cheats, bots, automation, modified clients or exploits, or otherwise interfere with the intended operation of the Service, including the fairness of leaderboards.

The Service is licensed to you, not sold. SynapSys Software reserves all rights not expressly granted in these Terms.

3. Purchases, virtual items and currency

GeoChopper is free to download and play. It also offers optional in-app purchases, such as cosmetic skins, trails, streak protection and mission tickets. In the App Store and Google Play editions, all purchases are processed by the app store you downloaded the app from under their terms and payment methods. In the Solana Mobile edition, purchases can also be paid directly from your connected Solana wallet; see the Solana section below.

• Virtual items and in-game currency, including coins, tickets, experience, cosmetics and any other in-game rewards, are a limited license to use a feature of the Service. They have no monetary value, are not your property, and cannot be redeemed for cash or exchanged for anything of real-world value outside the game.
• Virtual items and currency are non-transferable and non-refundable except where required by law or by the applicable app store's policies.
• We may manage, regulate, modify, or remove virtual items and in-game features at any time, with or without notice, and we have no liability to you for doing so.
• Refund requests are handled by the applicable app store in accordance with its refund policy.

Solana Mobile edition: wallet payments, NFTs and SKR

The Solana Mobile (dApp Store) edition of GeoChopper offers an optional on-chain layer. Connecting a wallet is never required to play. If you choose to use it, the following additional terms apply:

• Wallet payments are final. Purchases paid in SOL, SKR or USDC are blockchain transactions that you sign and submit from your own wallet. Once confirmed on the Solana network they cannot be reversed or refunded, except where required by law. Displayed token prices track a fixed reference price and refresh periodically, so the token amount may change between visits. You also pay the network's transaction fees.
• NFTs are an exception to the virtual items rule above. A skin or other item minted as an NFT is a digital asset in your wallet that you own and may transfer or trade. What you own is the on-chain token; the in-game skin remains licensed content of the Service.
• In-game use of an NFT follows the wallet that holds it. If you transfer, sell or otherwise lose control of an NFT, the matching in-game item leaves your account with it. Converting an in-game skin into an NFT moves that ownership on-chain in the same way and cannot be undone.
• No value guarantee. We make no promises about the market value, tradability or future availability of any NFT or token. Secondary sales of GeoChopper NFTs carry a 5% creator royalty where the marketplace applies it.
• SKR rewards are promotional. SKR drops come from limited reward pools with daily and total caps. Pools can be paused, changed or ended at any time; rewards already granted to your account remain claimable. SKR rewards are a game feature, not income, compensation or an investment.
• Your wallet is your responsibility. We never hold your private keys or recovery phrase and cannot recover wallets, reverse transactions, or restore assets sent to the wrong address.

4. Acceptable use

You agree to use the Service only for lawful purposes and in line with these Terms. You will not use the Service to break the law, infringe the rights of others, disrupt or overload our systems, attempt to gain unauthorized access to any part of the Service, or submit false or manipulated scores. We may suspend or restrict access to protect the integrity of the game.

5. Accounts

You can play anonymously, or sign in with Google or Apple to save and sync your progress. You are responsible for maintaining the security of any account you use and for activity that occurs through it. Please choose a leaderboard display name that does not impersonate others, infringe rights, or contain offensive content. We may change or remove display names that violate these Terms. Information you provide is handled in accordance with our Privacy Policy.

6. Intellectual property and copyright

The Service and all of its content, including the GeoChopper name and logo, the software, artwork, aircraft and skin designs, maps and map styling, characters, user interface, text, sounds, music and all other materials, are owned by SynapSys Software or its licensors and are protected by copyright, trademark and other intellectual property laws.

All other trademarks, service marks and trade names referenced in the Service are the property of their respective owners and are used for identification purposes only, which does not imply any endorsement.

Except for the limited license granted to you in these Terms, nothing gives you any right, title or interest in the Service or its content. You may not use our name, logo or branding without our prior written permission.

If you believe that content within the Service infringes your copyright, please contact us at info@synapsys-software.com with enough detail for us to identify the material and your rights, and we will review your request.

Third-party data and content attributions

GeoChopper is built in part on open data and third-party content. We gratefully acknowledge the sources below. Where a license requires it, the applicable credit and license are shown. Datasets marked "adapted" have been processed and restyled by us for use as in-game maps.

7. Third-party stores and services

Your use of the app is also subject to the terms of the app store you downloaded it from. The following additional terms apply where relevant.

Apple App Store

These Terms are between you and SynapSys Software only, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide any maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal or regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Google Play

Your use of the app obtained from Google Play is also governed by the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app.

Solana dApp Store

If you downloaded GeoChopper from the Solana dApp Store, your use of that store is governed by the Solana dApp Store terms from Solana Mobile, Inc. The Solana blockchain itself is a public network that we do not operate or control, and its availability and fees are outside our responsibility.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any information in the game (including geographic content) is complete or accurate for any particular purpose. GeoChopper is intended for entertainment and general education and should not be relied upon for navigation or any official purpose. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law, SynapSys Software and its owners, employees and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits, revenue or goodwill, arising out of or related to your use of, or inability to use, the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or ten euros (EUR 10). Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

10. Indemnification

You agree to indemnify and hold harmless SynapSys Software and its owners, employees and licensors from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may stop using the Service and delete the app at any time. We may suspend or terminate your access to the Service, in whole or in part, if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. Upon termination, the license granted to you ends and you must stop using the app. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and governing law, will continue to apply.

12. Changes to the Service and Terms

We are always improving GeoChopper and may add, change or remove features at any time. We may also update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the Netherlands, without regard to its conflict of laws rules, and the courts of the Netherlands will have jurisdiction, except where mandatory consumer protection law in your country of residence provides otherwise. Nothing in these Terms affects your rights as a consumer that cannot be waived by agreement.
